AB 1196 will ban the use of carotid artery restraint (chokehold) by law enforcement officers to forcibly detain a suspect in California. This deadly tactic has ended multiple lives, including George Floyd, Elijah McClain, and Eric Garner.
The bill is currently in the California State Senate's Rules Committee and we need you to contact these Senators to urge them to VOTE YES at the next Senate hearing.
AB 1196 was introduced by Assemblymember Mike A. Gipson (D-Carson) as a response to the murder of George Floyd in Minneapolis, Minnesota by several law enforcement officers.
"The world watched as the 200 lb. weight of a police officer was leveraged on the neck of George Floyd for over 8 minutes. Two other officers held him down and another watched as his body succumbed to the attack and went limp before expiring. This dangerous technique compresses the carotid artery and stops blood flow to render the suspect unconscious. The deadly use of force technique can be performed using any object and can easily go wrong, this time it was a knee,” said Assemblymember Gipson.
If passed into law, this bill would specifically and clearly "prohibit a law enforcement agency from authorizing the use of a carotid restraint.”
Last year, California Governor Gavin Newson signed 'Stephon Clark's Law' (AB 392) after the California State Legislature passed the bill. Authored by Assemblymember Shirley Weber (D-San Diego), the law mandates restrictions on the use of lethal force.
As used in this legislation, “carotid restraint” means a vascular neck restraint or any similar restraint, hold, or other defensive tactic in which pressure is applied to the sides of a person’s neck for the purpose of restricting blood flow to render the person unconscious or otherwise subdue or control the person.
